Abstract
Taiwan’s Constitutional Court heard oral arguments on the constitutionality of the death penalty in April. After five months of deliberation, on September 20, the Court pronounced the Judgment 113-Hsien-Pan-8 hereafter referred to as “Judgment No. 8”). Despite the issues raised during the hearing, the ruling refrained from deciding on the constitutionality of the death penalty as a legal penalty.
